N.C. G.S. § 116-198.34.(8b) authorized UNC BOG to designate real property held by, or to be acquired by, a constituent institution as a millennial campus. Legislation states the Board should act on the recommendation of the President after the President has consulted with the Chancellor and the Board of Trustees.  The designation should be based on the express finding that the institution has the administrative and fiscal capacity to create and maintain such a campus.   Upon formal request by the constituent institutions, the Board of Governors may authorize two or more  constituent institutions   which meet the requirements of this section to create a joint Campus. Millennial Campus' as defined in the stature is real property and appurtenant facilities designated by the Board of Governors-NC GS§ 116-198.33  emphasis added

UNC at Charlotte proposed UNC Tomorrow Statewide Nano Network collaboration between UNC institutions involved in nanotechnology and Nanoscience excludes NC A&T and NC Central.  Between 2000-05 NC A&T conducted 11 Millions dollars of  nanotechnology research compared to  5.5 million at UNCG and $44,000 dollars at UNCG.  HBI NCCU conducted 2.3 Million compared to $44,000 at UNCG.

UNCG Board of Trustees Business Affairs Committee Feb. 2, 2006

UNCG Trustees Business Affairs Committee minutes allege  Philip Richman, vice chancellor for UNCG business affairs, advised the Board that the School of the Deaf property became available in 2002. NC A&T and UNCG
  asked that the property be transferred to the campuses with formed the Joint Millennium Campus without a word pertaining to NC A&T Farmland.  UNCG Chairman Tom Ross, now UNC President, moved to approved recommendation calling for  leasing  Identified JMC to the full board  of Trustees.  William Pratt seconded the Motion which was unanimously approved for recommendation to the full Board.  UNCG Board Trustee Minutes allege:  the Board of Trustees of The University of North  Carolina at Greensboro . approve the Lease Agreement between the Greensboro Center for  Innovative Development and UNCG and NCA&T and recommend approval to the Board of Governors
 
Jan. 2006,  Erskine Bowles became President of UNC System. " The Greensboro Boy" Erskine Bowles maybe the pitch man who the voters reject losing out in back-to-back North Carolina US Senate races in 2000 and 2004 with the recognizable name in Democrat tic circles which the political class place in public policy positions notwithstanding votes wishes. Bowles joined Greensboro Jim Phillips, Jr. at UNC who served as Bowles Campaign finances manager in the 2000 Senate race and was a member of the UNC president search committee which four of the thirteen members had Greensboro, NC roots - as reported in the media.

NCA&T and UNCG University Chancellors Renick and Sullivan August 3, 2003 signed off on
 Articles of Incorporation for Nonprofit The Greensboro Center for Innovative Development as natural persons that  were filed with the Secretary of State Oct. 30, 2003 establishing the Corporation.   Documents received from State office of Budget and Finance indicated  the GCID wasn't a state entity which should raise the question of ownership of university administrative officials established nonprofits.  UNCG Trustees Business Affairs Committee minutes allege  Philip Richman, vice chancellor for UNCG business affairs, advised the Board that the School of the Deaf property became available in 2002. NC A&T and UNCG asked that the property be transferred to the campuses with without a word pertaining to NC A&T Farmland.   John Merrill Executive Director of the Greensboro Center for Innovative Development spoke and signed off on  background document recommend approval of the lease.    And Tom Ross then UNCG BOT Chair and now UNC .  President recommended lease approval to full board.

  the actions items approved the the Executive Committee which meet via teleconference to discuss, two personnel items, one property matter, etc. which  unambiguous suggest Executive Committee approval alone is insufficient to authorize a course of action.

Bleeding out taxpayers,  alleged JMC Gateway Research Park  maybe icon for  Occupy Raleigh  and University of North Carolina Board of Governors.  In 2009 when an estimated 5000 teachers lost their  jobs, unemployment at an all time high and food banks at an all-time low, the alleged Joint Millennial Campus  received $ 49,274.294  taxpayer dollars to build  a Joint School of Nanoscience and  Nanoengineering Research Building owned by  private corporation Gateway Research Park. Inc. Millennial Campuses Financing Act. NCGS § 116-198.31 dictates no pledge of taxes or the faith and credit of the State or any agency or political subdivision thereof, to pay the cost, in whole or part, of buildings, structures, or other facilities.   The sources of funds used to repay the $10 million authorized in 2004 for the Joint Millennial Campus were the Health and Wellness Trust Fund (HWTF) and the Tobacco Trust Fund (TTF).  The session law (SL 2004-179) that authorized the use of debt for  the JMC also required the HWTF and TTF to pay the debt service on this project as well as nine other health and education projects and up to five and youth development facilities.  Although these two trust funds have been abolished, the same source of funds (Master Settlement Agreement- MSA) that used to support them is still being used for debt service. Greensboro Attorney, UNC BOG Chairman Jim Phillips, Jr.  at the  Sept.  2006 UNC-BOG board meeting  suggested  delegation to the President (Bowles) certain tasks what he termed as operation issues within the University, that historically were acted on in the committee setting. Phillips would say “in fact, during this past session of the General Assembly, this board was specifically authorized to delegate such things, as we deemed appropriate.”  The board as part of the University of North Carolina 2006 Non-Budget Legislative Agenda requested it be allowed to delegate statutory duties to the President.   UNC-BOG (11.13.2006) authorized authority previously held by UNC-BOG  to the President (Bowles) may have created a Higher Education Czar with iron grip on the university with the:

·         Authority to appoint and set the salaries of Senior Academic and Administrative and other employees exempt from the State Personnel Act serving with the UNC General Administration.

·         Authority to set salary ranges for Senior Academic and Administrative officers of the constituent institution of university.

·         Authority to approve conferrals of tenure and to ser salaries of faculty, Senior Academic and Administrative officers, except the chancellors, and other employees exempt from the State Personnel Act at campuses etc....

 

Governance in the Public Interest: A Case Study of the University of North Carolina System , determined “ The Board spends substantial amounts of time on activities that should be transferred to the institutional boards of trustees, thus leaving more time for the Board to focus on system-wide concerns such as improving academic quality, assessing student learning, and better managing costs. The Board too often uses the consent agenda for issues deserving more debate such as program approval, property acquisition, and mission review. And:

·         The long-range strategic plan is staff-driven, not Board-driven.

·         The Board sometimes uses academic freedom to excuse questionable academic judgments. [9]

Former Fayetteville State Chancellor Dr. Thelma J. Bryan would sue The University of North Carolina (Thelma J. Bryan vs. The University of North Carolina) alleging  Race and Gender discrimination which containing  numerous allegations pertaining to  President Bowles.  Dr. T.J. Bryan, "alleged Bowles told her that if she did not agree to resign then she would never work in higher education again."[P22]  and  she “spoke to Mr. Harold Martin Vice-President of Academic Affairs. "He told Dr. Bryan to sign the letter right of resignation "now" or the deal to continue her employment as a part-time employee was off the table." [P27] The suit alleged Dr. Bryan, suffered, and continues to suffer, mental, emotional, and physical trauma because of the gender and racial discrimination committed by the Defendant.[P48}.

 
 
Gateway Research One, financed with private money where lease hold improvements accrue to Lessor, was only 50% occupied a year before a JSNN degree was authorized - Nov. 2009 and two years before students would enter degree programs- Sept. 2010,  Sept 2008 pursuant delegated authority UNC President Erskine Bowles approved a three year,  4,300 sq. ft. lease ($540,000) for temporary Lab and office space for JSNN program at Research One, at Gateway Research Park Inc. described as an Education Research company, while permanent building was being constructed. The universities would later say they could host degree program  on campus first year, 2010-2011
